Mushrooms in Michigan
Michigan has not legalized psilocybin. Six jurisdictions have changed how their own police prioritize it, the rest of the state has not, and the difference between those two sentences is where most of the confusion lives. Here is the honest picture.
The statewide answer
Psilocybin is a controlled substance under Michigan law and under federal law, in every county, with no medical or retail exception anywhere in the state. Michigan built a licensed framework for cannabis — licence classes, a regulator, seed-to-sale tracking. It has built nothing equivalent for psilocybin, and there is no application you can file to become a licensed mushroom dispensary here, because the category does not exist.
What has happened instead is municipal, and it is narrower than most people assume. Individual city councils — plus one county prosecutor and, in Detroit, the voters — have said that personal possession and use of entheogenic plants and fungi should be the lowest priority for their own officers. That is a statement about how a local police department spends its time. It does not rewrite the statute, and it stops at the city line.
Which Michigan jurisdictions have acted
In order, earliest first. Every one of these is a deprioritization measure, not a legalization, and each covers only its own jurisdiction.

City Council voted unanimously to make investigation and arrest for personal use, possession and growth of entheogenic plants and fungi the lowest law-enforcement priority in the city — the first Michigan jurisdiction to act.

The county prosecutor announced his office would not charge personal-use entheogen cases. That is a charging-policy decision covering the county, and it can change with the officeholder.

Voters — not the council — passed Proposal E, decriminalizing personal possession and therapeutic use of entheogenic plants and fungi by making it the city’s lowest law-enforcement priority. It is the only one of these carried at the ballot box.

City Council voted unanimously on a resolution covering entheogenic plants and fungi including psilocybin mushrooms, ayahuasca and DMT — the most recent of the Michigan measures.
That is the complete list. Michigan has more than 1,700 municipalities; six of them have moved. Everywhere else in the state — and on every state highway and federal property between them — the statute applies exactly as written.
What these measures do not do
- They do not legalize anything. Deprioritizing enforcement and legalizing conduct are different actions, and only the legislature can do the second one.
- They do not bind state or federal authorities. A city council instructs its own police department. State police and federal prosecutors are not party to that decision.
- They do not travel with you. A resolution in Ferndale means nothing three miles away in a city that has not passed one.
- They do not create a legal market. No licence, no regulator, no tested-and-tracked supply chain. Anyone claiming state licensure for psilocybin in Michigan is telling you something that is not true.
- They are not permanent. A resolution can be repealed, and a charging policy changes with the officeholder.

Are mushrooms legal in Michigan?
No. Psilocybin remains a controlled substance under both Michigan and federal law, statewide, with no exception. What has changed is enforcement priority in a handful of individual cities — Ann Arbor, Detroit, Hazel Park, Ypsilanti and Ferndale have each passed measures making personal possession and use the lowest priority for local police. That is a local enforcement posture, not legalization, and it does not bind state or federal prosecutors. Nothing on this page is legal advice.
Is there a licensed mushroom dispensary in Michigan?
No. Michigan built a licensed retail framework for cannabis; it has not done so for psilocybin. There is no license class, no state regulator for it, and no seed-to-sale system. Any business describing itself as a state-licensed psilocybin dispensary in Michigan is misdescribing itself — including, to be plain about it, us. Topia Detroit is a members-only shop, not a licensed dispensary, and we do not pretend otherwise.
Do the city resolutions protect me outside that city?
No. A deprioritization resolution reaches exactly as far as the jurisdiction that passed it, and no further. Crossing a city line does not carry it with you, and state police and federal authorities are not bound by a municipal resolution anywhere in Michigan.
Has Michigan tried to change the law statewide?
There have been legislative efforts at the state level to change how Michigan treats entheogenic plants and fungi, and none has become law. As of 2026 the statewide position is unchanged, and the only movement has been municipal.
